1. Introduction and Scope

These Terms of Service ("Terms") govern your use of the PIXL Studio application, the PIXL engine, website, and related services (collectively, the "Services") provided by:

By downloading, installing, accessing, or using PIXL, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Definitions

  • "PIXL" or "Software" means the PIXL Studio application, the PIXL engine, CLI tools, and all related documentation.
  • "Commercial Use" means any use by or on behalf of a for-profit entity, or any use intended to generate revenue.
  • "Consumer" means a natural person acting for purposes outside their trade, business, craft, or profession (as defined in Directive 2011/83/EU).
  • "User Content" means any sprites, tilemaps, artwork, PAX files, or other creative assets you create using the Software.
  • "Subscription" means a paid commercial license for the Software.

3. License Grant

3.1 Open Source License (MIT)

The core PIXL engine is released as open source under the MIT License. The full source code is available at github.com/SimplyLiz/PIXL.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

3.2 Personal Use (Free)

You may use PIXL free of charge for personal, non-commercial purposes, including:

  • Personal game development and hobby projects
  • Learning and experimentation
  • Contributing to open source projects (where you are not compensated)
  • Academic research and educational purposes

3.3 Commercial Use (Paid License Required)

A paid license is required for any Commercial Use, including but not limited to:

  • Use by any for-profit game studio or organisation
  • Creating assets for commercial games or products
  • Integration into products or services offered for sale
  • Use by employees, contractors, or agents on behalf of a commercial entity

4. Subscription and Payment Terms

4.1 Subscription Period

Commercial licenses are sold as subscriptions on a monthly or annual basis. Subscriptions automatically renew unless cancelled.

4.2 Payment

Payment is processed by Stripe, Inc. Prices do not include taxes; you are responsible for all applicable taxes including VAT where applicable.

4.3 Cancellation

You may cancel your subscription at any time. Your commercial license remains valid until the end of the current billing period. You may continue using the free personal tier after your commercial license expires.

4.4 Refunds

We offer a 14-day money-back guarantee on all new subscriptions. Contact lisa@tastehub.io within 14 days of your initial subscription date for a full refund.

5. Consumer Rights (EU/EEA)

If you are a Consumer within the EU or EEA, you have a 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU).

To exercise withdrawal, send an unequivocal statement to lisa@tastehub.io.

You acknowledge that by downloading or accessing the Software immediately after purchase, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the download begins.

6. Your Content and Intellectual Property

6.1 Your Artwork

PIXL processes your artwork locally on your machine. We do not claim any ownership or rights over your sprites, tilemaps, or any creative assets you produce. Your artwork remains entirely yours.

6.2 AI-Generated Content

Assets generated or assisted by PIXL's AI features (sprite generation, art direction, style learning) are your property. We make no claims on AI-assisted output.

6.3 Our Intellectual Property

The PIXL name, logo, and branding are proprietary. The open source engine is licensed under MIT. All rights not explicitly granted are reserved.

7. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Circumvent license restrictions or usage limits
  • Remove or alter copyright or proprietary notices
  • Use the Services to develop a competing product
  • Interfere with or disrupt the Services

Note: The MIT License permits modification and redistribution of the open source engine. This section applies to commercial services and support, not to your rights under the MIT License.

8. Disclaimer of Warranties

The Software is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

For paid subscriptions, we warrant that the Services will be provided with reasonable skill and care and will substantially conform to their published description. If you are a Consumer, your statutory rights remain unaffected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our total cumulative liability shall not exceed the amounts paid by you in the twelve (12) months preceding the claim, or one hundred euros (€100), whichever is greater.

In accordance with Austrian law, nothing excludes liability for death or personal injury caused by negligence, fraud, intentional misconduct (Vorsatz), or gross negligence (grobe Fahrlässigkeit).

10. Termination

You may terminate these Terms at any time by ceasing to use the Services and cancelling any subscription. We may terminate or suspend access if you breach these Terms or fail to pay subscription fees.

Upon termination, your commercial license is revoked but you may continue using the Software under the MIT License for personal, non-commercial purposes.

11. Governing Law and Jurisdiction

These Terms are governed by Austrian law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

If you are not a Consumer, disputes are subject to the exclusive jurisdiction of the courts of Vienna, Austria. If you are a Consumer resident in the EU/EEA, you may bring proceedings in Austria or your country of residence.

The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement. We may modify these Terms with 30 days' notice. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver.
